Fed: Ruddock foreshadows high court appeal in al Masri case

Immigration Minister PHILIP RUDDOCK has foreshadowed a High Court appeal against aFederal Court decision that curbs the federal government's power to detain asylum seekers.

The full bench of the court yesterday ruled against the minister who had appealed againsttwo earlier court orders that asylum seeker AKRAM AL MASRI be released from detentionpending his deportation.

The landmark decision ruled that the government was not entitled to keep Mr AL MASRIin indefinite detention while he waited for his deportation to be arranged.

Refugee advocates say the case has implications for possibly thousands of asylum seekers,but a spokesman for Mr RUDDOCK estimates it has ramifications for only about 10.

Mr RUDDOCK'S spokesman says the minister has asked the department to review the judgmentwith the view to lodging an appeal.
